Allahabad High Court
DIGVIJAY NARAYAN SINGH AND 2 OTHERSversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The High Court upheld the Additional Commissioner’s order declaring 67.29 acres surplus, finding no perversity or failure to consider material, and dismissed the writ petitions.
Summary
The petitioners challenged the order of the Additional Commissioner that declared 67.29 acres of their ancestral land surplus under the Uttar Pradesh Imposition of Ceiling on Land Holdings Act, 1960. They argued that the Commissioner exceeded the notice amount, ignored earlier remand orders, and improperly rejected their claims of "bāg" land, exemption for their minor sons, and abadi status. The High Court examined the factual findings of the appellate authority, the validity of the 25‑06‑1984 Prescribed Authority order, and the scope of certiorari under Supreme Court precedent. It held that the appellate authority’s findings were based on material on record and were not perverse. Consequently, the Court dismissed the writ petitions and upheld the declaration of 67.29 acres as surplus.
Issues considered
- The Additional Commissioner’s power to declare surplus land beyond the notice amount under the Ceiling Act.
- Whether the order of the Prescribed Authority dated 25‑06‑1984 became final despite subsequent remand.
- Whether the appellate authority’s factual findings can be set aside on a writ of certiorari.
- The validity of the petitioners’ claims that certain parcels constitute "bāg" or abadi land and merit exemption.
- The applicability of exemption provisions for minor sons under the Zamindari Abolition provisions.

occasions and lastly a Coordinate Bench of this Court vide an order
dated 27.06.2023 on a writ petition filed by petitioners’ father being Writ
No. 21052/1994 allowed it in part and in order to give clarity to all
necessary facts which is being extensively mentioned in said judgment
are quoted below in its entirety :-
“1. This writ petition has been filed assailing the order passed by
Additional Commissioner, Kanpur Division, Kanpur in Appeal No. 157
and 158, filed under Section 13 of Uttar Pradesh Imposition of Ceiling
on Land Holdings Act, 1960 (hereinafter called as ‘Act of 1961’), dated
30.03.1994 and the order passed by Prescribed Authority, Kannauj
dated 25.06.1984.
2. This case has a long chequered history, a brief disclosure of the facts
are necessary for better appreciation of the case.
3. One Sharda Narain Singh, original tenure holder was issued notice
under Section 10(2) of the Act of 1961 showing that he was holding
total land measuring 112.60 acres, and after retaining 28 acres of land
remaining 84.60 acres was to be declared surplus. Objections were filed
by tenure holder against the notice so issued, but the Prescribed
Authority rejected the objections and maintained the notice and by
order dated 28.06.1976 declared 84.60 acres of land as surplus.
4. Against the order of Prescribed Authority, an appeal was preferred
before the District Judge, Farrukhabad, which was allowed vide order
dated 23.09.1977 and the matter was remitted back to Prescribed
Authority to decide afresh. Post remand, the Prescribed Authority
declared 70.03 acres land as surplus vide judgment dated 27.11.1978.
5. Aggrieved by the order, petitioner filed an appeal before the District
Judge, Farrukhabad which was again allowed by order dated
10.09.1980 and the case was remitted back to Prescribed Authority with
a direction to make local inspection and give finding on Issue No. 16
afresh. Prescribed Authority was also to take into consideration the
choice of the tenure holder before declaring any surplus land. After
remand, the Prescribed Authority on 25.06.1984 allowed objections in
part and declared 46.63 acres of land as surplus.
6. Against that judgment, two appeals were filed before the District
Judge, Farrukhabad, one by petitioner and the other by the State. Both
appeals were transferred to Commissioner, Allahabad Division,
Allahabad in terms of the amendment in the Act. The Additional
Commissioner on 25.01.1988 dismissed the appeal filed by the
petitioner, however, allowed the appeal of the State holding 67.29 acres
of land as surplus.
3
WRIC No. - 46117 of 2025
7. Against the order of Additional Commissioner, petitioner filed a
Civil Misc. Writ Petition No. 6378 of 1988 which was partly allowed
on 16.01.1989 and the matter was sent back to Commissioner,
Allahabad for re-determination. After the remand, the Additional
Commissioner, Kanpur Division, Kanpur dismissed the appeal filed by
petitioner and allowed the appeal filed by State by a common order
dated 30.03.1994 and declared 89.50 acres of land as surplus, while
allowing the petitioner to retain only 23.10 acres of land. Hence, the
present writ petition.
8. Learned counsel for the petitioner submitted that the Additional
Commissioner was not correct in enhancing the area of irrigated land
declaring surplus to the tune of 89.50 acres of land which was beyond
what was given in notice under Section 10(2) of the Act wherein land to
be declared as surplus was shown at 84.60 acres. He further contended
that court below committed a gross error by setting aside the order
dated 27.11.1978 passed by Prescribed Authority which was already set
aside by the appellate court on 10.09.1980. According to him, the
Additional Commissioner could not have declared area of 89.50 acres
as surplus, when the notice itself mentioned only 84.60 acres. The
appeal filed by the State was against the judgment dated 25.06.1984
whereby 46.63 acres of land was declared surplus and the appeal was
with the prayer to declare 70.02 acres of land as surplus pursuant to
order of Prescribed Authority dated 27.11.1978, and the Additional
Commissioner has gone beyond what has been asked by the State in its
appeal.
9. He then contended that the Additional Commissioner while framing
the five issues in appeal of the petitioner and two issues in appeal filed
by the State decided the same in a cursory manner without recording
any finding and looking to the evidences which were there on record.
10. Per contra, learned Standing Counsel has defended the order passed
by Additional Commissioner and submitted that finding has been
recorded on all the five issues framed in the appeal of the petitioner and
it was found that petitioner has not submitted any evidence so as to
substantiate the claim as such the issues were decided against the
petitioner.
11. I have heard respective counsel for the parties and perused the
material on record.
12. This is a case where the order passed by Prescribed Authority
holding the land of the petitioner surplus has been remanded back by
appellate court for taking decision afresh with certain directions. The
writ Court once in the year 1989 has also remanded the matter back to
appellate authority to consider and decide the appeal on basis of the
material which are there on record.
4
WRIC No. - 46117 of 2025
13. Post remand dated 16.01.1989, the matter was heard by Additional
Commissioner on both the appeals filed by the petitioner as well as the
State assailing the order passed by Prescribed Authority dated
25.06.1984. The Prescribed Authority by order dated 25.06.1984 had
partly accepted the objections of the petitioner and held 46.63 acres of
land as surplus, while the notice issued under Section 10(2) of the Act
mentioned 84.60 acres of land to be declared surplus. This order of
1984 was challenged both by petitioner raising several grounds as well
as by State on the ground that order passed on 27.11.1978 was correct
wherein 70.03 acres of land was declared surplus. The Additional
Commissioner while framing the issues to be decided in the two
appeals proceeded to examine each issue separately and found in the
appeal filed by petitioner that as no evidence was adduced by petitioner
to substantiate its claim, and it recorded adverse finding in three of the
issues while without recording any finding in two other issues decided
the same against the petitioner.
14. Moreover, the Additional Commissioner while allowing the appeal
of the State got swayed away by the order of the Prescribed Authority
dated 27.11.1978 and set aside the same which was not in existence as
the same was already set aside by District Judge on 10.09.1980. The
Additional Commissioner could not have proceeded to hold surplus
land to the extent of 89.50 acres, when the notice clearly mentioned
84.60 acres to be declared surplus.
15. It seems that Additional Commissioner in its exuberance to decide
the matter has not set aside the order dated 25.06.1984 which had partly
allowed the objections of the petitioner and declared 46.63 acres of land
as surplus. Once the order of the Prescribed Authority dated 25.06.1984
stands, the order passed by the appellate court on 30.03.1994 cannot
hold ground separately and unless and until the order passed by
Prescribed Authority on 25.06.1984 is set aside which was under
challenge in both the appeals filed by petitioner as well as State, the
order dated 30.03.1994 cannot stand.
16. The Additional Commissioner fell in trap by setting aside the order
passed by Prescribed Authority dated 27.11.1978 which was non-
existent and was already set aside by the District Judge on 10.09.1980
and proceeded to set aside the same and allowed the appeal of the State
by declaring 89.50 acres of land as surplus.
17. Considering the facts and circumstances of the case, I find that the
judgment dated 30.03.1994 passed by Additional Commissioner,
Kanpur Division, Kanpur, respondent no. 2 is unsustainable in the eyes
of law and the same is hereby set aside.
18. The matter is remitted back to Additional Commissioner to decide
the same after affording opportunity of hearing to all the affected

parties and considering the relevant material on record. The entire
exercise shall be completed by the Additional Commissioner within
next six months.
19. It is made clear that no adjournment shall be granted to either of the
parties.
20. In view of above, writ petition stands partly allowed. ”
3. In order to give more clarity, the order passed by Prescribed
Authority dated 25.06.1984 is also quoted below whereby 46.63 acres of
land of petitioners’ father was declared surplus :-

6. The Appellate Authority rejected the claim of petitioners for 2.03
acres as 'बाग' since no evidence was produced that said land can be
declared 'बाग' or it may fall within the definition of 'बाग' and further claim
that said land if not declared as 'बाग', it be declared as unirrigated could
not be considered, since it was never raised during earlier proceedings.
Accordingly, said claim and argument is rejected.
7. The third claim that once son of petitioner has attained majority,
his shares be exempted and for that specific finding has been returned
that when gift deed was made on 29.07.1970, at that time, age of both
sons were less than 18 years and since both sons were born after
settlement of Zamindari, therefore, benefit of exemption could not be
granted and since finding of fact is not perverse, therefore, accordingly,
said argument is also rejected.
8. A specific finding was returned that in absence of any date of birth
certificate, a claim that son was major on 08.06.1973 cannot be accepted.
12
WRIC No. - 46117 of 2025
A further claim on that Araji No. 682, 801 was abadi was also found to
be incorrect since it was found to be used for purpose of agriculture and
not an abadi and no evidence in contrary was brought on record.
9. A submission before this Court that report was submitted ex-parte
or they were not called for filing objections could not sustain since much
variance was not found in earlier report and subsequent report as well as
the findings returned by the Appellate Authority were based on record.
10. In writ petition as well as in written submissions, it is stated that
order passed by Prescribed Authority dated 25.06.1984 has become final
would be in the teeth of a judgment of Coordinate Bench of this Court
on 27.06.2023 since matter was remitted back to consider on all issues of
facts and of law.
11. Court finds that by the impugned order, Appellate Authority has
made a scrutiny of the order passed by Prescribed Authority on
25.06.1984 and returned a finding on basis of above consideration and
declared that 67.29 acres of land as surplus except 17.35 acres land from
proposed 84.60 acres land. Said findings were specifically returned in
paragraph 10 of the impugned order and said finding returned on fact
being observed on material cannot be disturbed.
12. Court also takes note of a report of Tehsildar dated 06.02.2026
which is placed on record by way of counter affidavit which though
considered and mentioned in impugned order but in latter part of
paragraph 8, the issues were considered on law as well as on facts and
material on record and not entirely based on the report. The issue raised
and considered therein are neither being confronted specifically in writ
petition or in the written submissions, therefore, findings have
accordingly cannot be set aside.
13. In aforesaid circumstances, even though petitioner may not be
participated in inspection but as referred above, entire impugned order
was passed on basis of material available and specifically rejected the
13
WRIC No. - 46117 of 2025
claim of petitioner so far as बाग or unirrigated land is concerned, in
absence of any material contrary to contradict said finding as well as that
they were failed to produce any document about the date of majority of
two sons in relation to date of hibbanama. Entire writ petition or written
submissions are silent on this issue.
14. Accordingly, as held by Supreme Court in Basamma and another
vs. Goparappa and another, 2026 INSC 712, writ of certiorari can be
made only when there is perversity or Authorities have failed to consider
the material on record whereas as discussed above, said circumstance
does not exist.
15. In aforesaid circumstances, this Court does not find any merit in
both writ petitions, hence, both writ petitions are dismissed.
