Allahabad High Court

ISHAN INSTITUTE OF LAWversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The writ petition was dismissed as infructuous because the underlying appeal had been finally decided.

Summary

The Ishan Institute of Law filed a writ petition (Writ No. 6933 of 2026) before the Allahabad High Court challenging certain actions of the State of Uttar Pradesh and two other respondents. The petitioner sought relief, but the Respondent No.1 filed a personal affidavit indicating that the appeal (Appeal No. 183/70-02-2025) filed by the institute had been finally decided. Subsequently, a court order dated 24 April 2026 resolved the matters raised in the appeal. The petitioner’s counsel argued that, in view of this subsequent order, the writ petition had become infructuous. The court accepted this submission, held that there was no longer any live controversy, and dismissed the writ petition as infructuous, consigning it to the records.
