Allahabad High Court
RAVINDRA SINGHversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The court held that the matter requires factual enquiry and therefore ordered a fresh representation by the petitioner and an expeditious, reasoned decision by the authority, disposing the writ petition.
Summary
Petitioner Ravindra Singh filed a writ petition seeking allotment of 6% developed abadi land from his acquired parcels in Khasra No.49 and No.126 in Dadha village, Gautam Budh Nagar. The court observed that the claim required a factual enquiry and therefore refrained from deciding the merits. It directed the petitioner to make a fresh representation before the concerned authority within two weeks, attaching a copy of the order. The authority was instructed to pass a reasoned, speaking order in accordance with law within six weeks. The writ petition was consequently disposed.
Issues considered
- Whether the petitioner is entitled to the claimed 6% developed abadi land without a factual enquiry
