Allahabad High Court

KUVERPAL SINGHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that the petition requires a factual inquiry and therefore ordered a fresh representation before the authority, disposing the writ petition.

Summary

The petitioner, Kuverpal Singh, filed a writ petition seeking allotment of 6% developed abadi land from his acquired land in Gautam Budh Nagar. The petition alleged that the authorities had not granted the requested portion. The Court observed that the matter required factual investigation and therefore could not be decided on the pleadings alone. It directed the petitioner to make a fresh representation to the respondent authority within two weeks, attaching a copy of the order. The respondent authority was instructed to decide the representation expeditiously and issue a reasoned order within six weeks. Consequently, the writ petition was disposed without a substantive ruling on the merits.
