Allahabad High Court

SMT. JAIWATIversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that the matter requires factual enquiry and therefore ordered a fresh representation before the authority, disposing the writ petition.

Summary

Smt. Jaiwati filed a writ petition seeking allotment of 6% developed abadi land from her acquired plot in Gautam Budh Nagar. The petition raised a procedural grievance that the authority had not granted the claimed allotment. The Court observed that the dispute required a factual enquiry and declined to decide the merits. It directed the petitioner to make a fresh representation before the Greater Noida Industrial Development Authority within two weeks, attaching a copy of the order. The authority was instructed to pass a reasoned order within six weeks, and the writ petition was thereafter disposed.

Issues considered

  • Whether the petitioner is entitled to the claimed 6% developed abadi land without further representation before the authority
  • Whether the Court can direct a fresh representation and prescribe a timeline for the authority's decision
