Allahabad High Court

ANURAG YADAVversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is disposed of, with the petitioner directed to file a fresh representation to the Superintendent of Police, who must decide it within one month.

Summary

The petitioner, Anurak Yadav, employed as a Helper in Meja Energy Nigam Pvt. Ltd., filed a writ petition alleging that the police had registered an NCR under Sections 115(2) and 3151(2) of the BNS against him, and that the responding authority failed to provide the verification report confirming his service. He claimed that despite multiple representations, no action was taken. The respondents argued that the petition could be disposed of without merit and suggested a direction to the Superintendent of Police to consider his grievance. The Court, without delving into the merits, dismissed the petition but allowed the petitioner to file a fresh representation, accompanied by a certified copy of the order, to the Superintendent of Police within one month, and directed the respondent to decide the matter within a month of receipt. The order thus provides a procedural remedy rather than a substantive adjudication of the grievance.

Issues considered

  • What relief, if any, is available to the petitioner for the non‑issuance of the verification report by the police?
  • Whether the writ petition should be entertained on its merits or disposed of with a direction to file a fresh representation?
