Allahabad High Court

RAMJI SINGHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court disposed of the writ petition, directing the petitioner to file a detailed representation before the Executive Engineer, who must decide it within one month.

Summary

The petitioner, a bona‑fide consumer of electricity, alleged that a faulty smart meter generated erroneous bills of Rs. 18,526 for February‑March 2025 and Rs. 1,28,025 for June 2025, despite regular payment of dues. He submitted multiple representations to the electricity department, which were ignored. The respondents argued that the writ petition should not be kept pending and suggested directing the petitioner to approach the Executive Engineer of the electricity board. The High Court, without delving into the merits, disposed of the writ petition, directing the petitioner to file a detailed representation with a certified copy of the order to the Executive Engineer within one month, and mandating the respondent to decide the representation within a month of receipt. The order thus provides a procedural remedy rather than adjudicating the substantive billing dispute.

Issues considered

  • What procedural direction, if any, can the High Court issue in a consumer writ petition concerning an erroneous electricity bill without deciding the merits?
  • Whether the writ petition should be dismissed outright or disposed with an order to file a representation before the concerned utility authority.
