Allahabad High Court
GUDDU AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The Court dismissed petitioner No.2's claim and permitted petitioner No.1 to file a fresh representation before the Tehsildar, without deciding the merits of the caste certificate grievance.
Summary
The petitioners, Guddu and another, filed a writ petition challenging the non-issuance of a caste certificate. The petitioner's counsel limited the relief sought to petitioner No.1, arguing that petitioner No.2's claim could not be entertained in the present petition. The Court dismissed petitioner No.2's application, allowing him to file a fresh petition, and directed petitioner No.1 to submit a fresh representation with a certified copy of the order to the Tehsildar of Tehsil Hunnaur, District Sambhal within one month. The Court did not examine the merits of the caste certificate grievance but merely prescribed a procedural step. The respondent authority was ordered to consider and decide the representation within one month of receipt. The order was signed by the two judges of the Allahabad High Court on 19 March 2026.
