Allahabad High Court
SURESH CHANDRA TIWAR AND 5 OTHERSversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The Court held that the grievance shall be examined by the Chief Executive Officer, Noida within six weeks, with a fresh representation after hearing the petitioners and any other affected persons.
Summary
The petitioners, who are existing street vendors, applied for vending shop allotments under Section 3 of the Street Vending Act, 2014 in various work circles and sectors, but the Noida Authority failed to issue licenses or allotment letters despite completing surveys and selection. They filed a writ petition seeking relief. The respondents, including the Development Authority, argued that the Tribunal meant to handle such matters lacks a judicial officer, and therefore requested that the Chief Executive Officer (CEO) of Noida examine the grievance. The Court considered the procedural vacuum and the need for timely redress. It directed that the CEO of Noida examine the petitioners' grievance within six weeks, after hearing them and any other affected persons, and to consider a fresh representation. The petition was consequently disposed.
Issues considered
- Whether the petitioners' grievance regarding non‑issuance of vending licenses can be directed to the Chief Executive Officer in the absence of a judicial officer in the Tribunal.
