Allahabad High Court
SANGEETA DEVIversusSTATE OF UTTAR PRADESH AND 3 OTHERS
- Decided
Holding
The court disposed of the petition without merits, directing the petitioner to file objections and the respondent to pass a reasoned order within stipulated timeframes.
Summary
The petitioner, Sangeeta Devi, applied for the issuance of Form F.L.7, which was pending before the second respondent. An adverse report dated 02‑06‑2026 was made by the Senior Superintendent of Police, Gorakhpur, and a copy was provided to the petitioner. The High Court, without examining the merits of the application, disposed of the writ petition subject to the petitioner filing objections to the police report, supported by a personal affidavit, within one week. The petitioner must also submit a copy of the order to the second respondent. The court further directed the second respondent to consider the objections and pass a reasoned order within two weeks thereafter. The order was signed by Justices Saumitra Dayal Singh and Swarupama Chaturvedi.
Issues considered
- What is the appropriate procedural remedy when an adverse police report is filed against a petitioner's application for Form F.L.7?
- Can the court dispose of the writ petition without addressing the merits, directing only procedural compliance?
