Allahabad High Court
M/S YAMEEN ENT UDYOGversusSTATE OF U.P. AND ANOTHER
- Decided
Holding
The order dated 16‑02‑2026 is appealable and the petition may be entertained on merits if an appeal is filed within two weeks.
Summary
M/s Yameen Ent Udyog filed a writ petition challenging an order dated 16‑02‑2026 passed by the State of U.P. The Court examined whether the order was appealable and whether the petition was barred by limitation. It held that the order is appealable and no jurisdictional error exists to warrant interference under Article 226. Although the limitation period may have expired, the Court allowed the petition to be entertained on merits provided the petitioner files an appeal against the order within two weeks from the date of the judgment. The writ petition was therefore disposed with that observation.

HON'BLE SWARUPAMA CHATURVEDI, J.
1. Undeniably, the order 16.02.2026 is appealable. No jurisdictional or other
fundamental error is shown to exist, that may warrant interference in
exercise of our extraordinary jurisdiction under Article 226 of the
Constitution of India.
2. To the extent, the limitation to file appeal may have just expired, the writ
petition is disposed of with the observation, subject to the petitioner availing
appeal remedy against the order dated 16.02.2026, within a period of two
weeks from today, the same may be entertained on merits, without raising
any objection as to limitation.
