Arman AliversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and sureties under Section 482(2) of the BNSS.

Summary

Arman Ali applied for bail in a criminal case under Sections 30(a), 38(i) and 41(i) of the Bihar Excise Act, alleging that 3,876.48 litres of liquor were recovered from a truck. The petitioner argued that he was not caught in possession, was not the owner of the truck, and was implicated solely on a confessional statement made by co‑accused Ranjit while in police custody, which he claimed lacked evidentiary value. He also highlighted his clean antecedents and that he had been in custody since 9 January 2026. The State opposed bail, contending the seriousness of the offences. The Court, after considering the submissions, granted bail on a bond of Rs 5,000 with two sureties, subject to the conditions of Section 482(2) of the BNSS, and ordered his release.

Issues considered

  • Whether bail should be granted to the petitioner in offences under the Bihar Excise Act.
  • Whether the confessional statement of a co‑accused made in police custody can be the sole basis for the accusation.
  • Whether the petitioner is likely to abscond or tamper with evidence.
