The Court granted bail to the petitioners subject to the conditions prescribed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioners, Ranjesh Kumar and Raushan Kumar, applied for bail in a case registered under Sections 126(2), 115(2), 109 and 3(5) of the Bharatiya Nyaya Sanhita, alleging they were falsely implicated due to local political and land‑dispute motives. The prosecution alleged that the petitioners assaulted an informant, her son and granddaughter, causing simple injuries. The petitioners contended they have no criminal antecedent, the injuries were minor, and they are willing to cooperate with the investigation. The State opposed the bail application. Considering the clean antecedent of the petitioners, the nature of the alleged injuries, and the lack of specific allegations against them, the Court ordered bail on the condition of furnishing a Rs.10,000 bond with two sureties and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether bail should be granted to the petitioners under Sections 126(2), 115(2), 109 and 3(5) of the Bharatiya Nyaya Sanhita.
  • Whether the circumstances and clean antecedent of the petitioners justify bail despite the prosecution's allegations.
  • Application of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita in granting bail.
