Holding

The court granted bail to the petitioner subject to a bond and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Suresh Chaudhary, was charged under multiple sections of the Bharatiya Nyaya Sanhita for allegedly assaulting an informant and her relatives. He contended that he was falsely implicated due to village politics and highlighted a three‑day delay in filing the FIR without explanation. The petitioner also disclosed two prior criminal antecedents for which he was out on bail, but offered to cooperate with the investigation. The State opposed the bail application. After considering the nature of the allegations, the delay in the FIR, the petitioner’s antecedents, and the submissions of counsel, the court ordered his release on bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious charges under the Bharatiya Nyaya Sanhita.
  • Whether the three‑day delay in lodging the FIR is a ground to grant bail.
  • Whether the petitioner’s prior criminal antecedents affect the bail decision.
  • Whether the alleged political motive influences the grant of bail.
