Holding

Bail was granted to Shaket Mahto subject to conditions, and Munna Mahto's bail application was dismissed as withdrawn.

Summary

Shaket Mahto and his brother Munna Mahto were implicated in a criminal case arising from a land dispute that allegedly led to an assault on an informant and her daughter. The petitioners filed bail applications; Munna Mahto's bail application was withdrawn after he was arrested, while Shaket Mahto sought bail pending possible arrest. The prosecution alleged that Munna Mahto had outraged the informant's modesty and inflicted a knife wound, and that the accused had also stolen a gold chain. The defense argued that Shaket Mahto was innocent, had no prior criminal record, and that the injuries were minor, seeking bail under the Bharatiya Nagarik Suraksha Sanhita. The court considered the nature of the charges under the Bharatiya Nyaya Sanhita, the petitioner's clean antecedents, and his willingness to cooperate with the investigation. Accordingly, the court granted bail to Shaket Mahto subject to a bond and conditions, and dismissed Munna Mahto's bail application as withdrawn.

Issues considered

  • Whether bail should be granted to Shaket Mahto despite charges under Sections 126(2), 115(2), 109, 303(2), 74, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita
  • Whether the bail application of Munna Mahto can be withdrawn due to his arrest
