Holding
Provisional anticipatory bail is granted to the petitioner subject to conditions and verification of his criminal antecedent.
Summary
The petitioner, Dilip Sah, was implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly recovering 126 litres of liquor from a bush near a Hanuman temple. He has six prior cases under the Excise Act and argues that he was not arrested at the spot, that the liquor was not in his possession, and that the investigation relied on secret information without proper inquiry. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnishes bail bonds of Rs 30,000 with two sureties and appears before the trial court within six weeks. The order is subject to verification of his criminal antecedent; if more than six prior cases are found, the bail may be revoked. The Court directed the trial court to confirm the bail if the antecedent is exactly six cases.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
- Whether the alleged recovery of liquor and the manner of investigation justify denial of bail.
