Dhananjay Yadav @ Dhananjay KumarversusThe State of Bihar

Holding

The court held that, in view of the petitioner’s lack of criminal antecedent, the minor nature of the injuries, and his willingness to cooperate, bail must be granted under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Dhananjay Yadav, faced arrest in a case registered under multiple sections of the Bharatiya Nyaya Sanhita for allegedly assaulting an informant and his friend with a knife and lathi on 8 September 2025, causing injuries. The petitioner contended that he was falsely implicated, the injuries were minor, the injury report did not match the FIR, and he had no prior criminal record, offering to cooperate with the investigation. The State opposed the bail application. The court examined the facts, the nature of the alleged offences, and the petitioner’s background, and found no compelling reason to deny bail. Consequently, the court ordered bail on the condition of a Rs.10,000 bond with two sureties and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, to be surrendered within six weeks.
