Patna High Court

Sumitra DeviversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to verification of the petitioner’s antecedent.

Summary

The petitioner, Sumitra Devi, sought anticipatory bail fearing arrest under Section 30(a) of the Bihar Excise Act for alleged recovery of 10 litres of liquor from her residence. She argued she has a clean antecedent, is a woman, and that the liquor was located in a joint family house, making it uncertain that she had knowledge or possession. She further contended that the 2018 amendment to the Excise Act abolished the concepts of deemed possession and presumed offender. The State opposed the bail. The Court, considering these submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and conditioned the order on verification of the petitioner’s criminal antecedent, allowing confirmation if she is found clean and revocation if any antecedent is discovered.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where alleged possession is in a joint family property.
  • Whether the 2018 amendment removing deemed possession affects the bail application.

such it cannot be alleged with certainty that it was petitioner
