Patna High Court

Tulashi Kumar @ Tulashi RamversusThe State of Bihar

Decided

DISPOSED

Holding

The court provisionally granted anticipatory bail subject to bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

Tulasi Kumar sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act, where police alleged recovery of 10 litres of liquor from a public bush, not in his possession. He argued the allegation was based on secret information and that the location did not belong to him, and that he had only one prior excise case. The State opposed the bail. The court granted provisional anticipatory bail on a bond of Rs.5,000 with two sureties, subject to verification of his criminal antecedent by the trial court. If the trial court finds more than one prior case, the bail will not be confirmed; if only one, the provisional bail will be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
  • Whether the police investigation, based on secret information, suffices to justify denial of bail.
