Patna High Court

Bajanti KumariversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of her antecedent.

Summary

Bajanti Kumari was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 750 ml of liquor from a vehicle she owned. She argued that she had a clean antecedent, was not in possession of the liquor at the time of seizure, and was unaware that the vehicle would be misused by others. The State opposed her request for anticipatory bail. The High Court, considering her submissions, granted provisional anticipatory bail on the condition of a Rs. 500 bail bond with two sureties, subject to verification of her criminal antecedent under Section 482(2) of the BNSS. The order stipulated that if any antecedent is discovered, the bail would be cancelled; otherwise, the provisional bail would be confirmed.

Issues considered

  • What is the applicability of anticipatory bail under Section 482(2) of the BNSS to the petitioner accused under Section 30(a) of the Bihar Excise Act?
  • Whether the petitioner’s clean antecedent and lack of possession of the seized liquor justify the grant of anticipatory bail.
