Bhola Paswan @ BholaversusThe State of Bihar

Holding

Provisional anticipatory bail is granted conditionally, subject to verification of criminal antecedents and compliance with the stipulated conditions.

Summary

The petitioners, three Paswan brothers, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 93.2 litres of liquor from a riverbank location not belonging to them. They argued they were not caught in possession and were implicated based on secret information without proper investigation. The State opposed the bail. The High Court granted provisional anticipatory bail conditioned on each petitioner furnishing a Rs.5,000 bail bond with two sureties and subject to verification of their criminal antecedents under Section 482(2) of the BNSS. The Court stipulated that if petitioner No.1 is found to have more than one prior case, his bail would not be confirmed, whereas if he has only one case and the others have clean records, the bail would be confirmed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under the Bihar Excise Act case.
  • Whether the petitioners' alleged concealment of prior criminal antecedents affects the grant of anticipatory bail.

petitioners were not apprehended from the spot as such nothing

was recovered from their conscious possession and even alleged

recovery is from a place which does not belong to the

petitioners and is accessible to villagers at large and they came

to be implicated based on secret information which is the easiest

way to implicate someone without holding a proper

                       5. Learned A.P.P. for the State opposes the prayer for

one case then it would be presumed that petitioners, for the
