Patna High Court

Ganesh Sahni @ KutumaversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

Provisional anticipatory bail is granted subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Ganesh Sahni, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 7 litres of liquor from a house and 70 litres from a bush. He contended that the liquor was not in his possession, the premises did not belong to him, and he had no relationship with the house owner, asserting that a hostile watchman had implicated him. The petitioner applied for anticipatory bail, which the State opposed. The Court granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed verification of his criminal antecedent within six weeks. The order stipulated that if the petitioner is found to have more than three prior excise cases, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 30(a) of the Bihar Excise Act.
  • Whether the circumstances justify granting provisional anticipatory bail pending verification of criminal antecedent.

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of three cases under the Excise Act and

allegation is of recovery of 7 liters of liquor from house of

                                4. Learned counsel for the petitioner submits that

petitioner was not apprehended from the spot as such nothing

was recovered from his conscious possession and even the

house from where the liquor was recovered does not belong to

of liquor was recovered from a place which does not belong to

the petitioner and is accessible to villagers at large and he came

to be implicated at the instance of Chowkidar with whom he is

on an inimical term. It is also submitted that if Chowkidar was

aware of the involvement of the petitioner in the occurrence

then why he did not inform the police prior to institution of the

          prosecution.

                       5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

three cases then it would be presumed that petitioner, for the

purposes of seeking anticipatory bail, had concealed his antecedent
