Provisional anticipatory bail is granted subject to conditions and verification of the petitioner’s antecedent.
Summary
The petitioner, Navin Ray, was implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly possessing 29.83 litres of liquor recovered from his house, which is a joint family property. He argued that he had no conscious possession, that the 2018 amendment abolished the concept of deemed possession, and that the complaint was motivated by an inimical watchman. The State opposed his request for anticipatory bail. The Court, considering the petitioner's clean antecedent and the lack of direct possession, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed verification of his criminal record. If any antecedent is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith. The order was made under Section 482(2) of the BNSS.
Issues considered
- Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where alleged possession is not proven.
- Whether the 2018 amendment to the Bihar Excise Act eliminates the doctrine of deemed possession and presumed offender.
- Whether the petitioner’s clean antecedent warrants provisional anticipatory bail pending verification.

the house or the liquor kept in the house was within his
knowledge and after amendment in the excise act in the year
2018, the concept of deemed possession and presumed offender
has been done away with and he came to be implicated at the
instance of Chowkidar with whom he is on an inimical term. It
is also submitted that if Chowkidar was aware of the
involvement of the petitioner in the occurrence then why he did
not inform the police prior to institution of the instant FIR
which casts an aspersion on the case of the prosecution.
