Holding

The Court granted provisional anticipatory bail subject to conditions and pending verification of the petitioner’s antecedent.

Summary

The petitioner, Tribhuwan Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for allegedly possessing 40.60 litres of liquor recovered from his house, which is a joint family property. He argued he had no conscious possession, a clean antecedent, and that the 2018 amendment abolished the concept of deemed possession and presumed offender. The State opposed the bail, contending the allegations warranted prosecution. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties and directed verification of the petitioner’s criminal antecedent by the trial court. If any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of alleged possession of liquor.
  • Whether the amendment to the Bihar Excise Act in 2018 eliminates the doctrine of deemed possession and presumed offender.

                   learned A.P.P. for the State.

                             2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                             3. Learned counsel for the petitioner submits that the

petitioner is a person with clean antecedent and allegation is of

recovery of 40.60 liters of liquor from house of the petitioner.

                             4. Learned counsel for the petitioner submits that the

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and the house in

the house or the liquor kept in the house was within his

knowledge and after amendment in the excise act in the year

2018, the concept of deemed possession and presumed offender

has been done away with and he came to be implicated at the

instance of local person, but then it is submitted that if local

person was aware of the involvement of the petitioner in the

occurrence then why he did not inform the police prior to

institution of the instant FIR which casts an aspersion on the

          case of the prosecution.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender within a period of six weeks

from today, be released on Provisional anticipatory bail on
