Patna High Court

Tuntun YadavversusThe State of Bihar

Decided

DISPOSED

Holding

Provisional anticipatory bail is granted subject to bond, sureties, and verification of antecedent, with confirmation contingent on the antecedent check.

Summary

The petitioner, Tuntun Yadav, sought anticipatory bail after the police registered a case under Section 30(a) of the Bihar Excise Act alleging he was involved in the recovery of 14.145 litres of liquor from a thatched hut that does not belong to him. The petitioner argued that he was not apprehended at the spot, no liquor was found in his possession, and the FIR relied on unnamed informant information, casting doubt on the prosecution’s case. The State opposed the bail, contending the seriousness of the offence. The Court granted provisional anticipatory bail conditioned on a Rs.5,000 bail bond with two sureties and directed verification of the petitioner’s criminal antecedent within six weeks. It further held that if more than one prior case is found, the bail would not be confirmed, but if only one prior case is verified, the provisional bail would be confirmed.

Issues considered

  • What is the appropriateness of granting anticipatory bail in a case under Section 30(a) of the Bihar Excise Act?
  • Whether the lack of seizure from the petitioner’s possession and reliance on unnamed informant affect the bail decision?
  • Whether the petitioner’s criminal antecedent should influence confirmation of anticipatory bail.

FIR it is alleged that local person disclosed the name of the

petitioner, but then the name of the person who disclosed the

name of the petitioner is not disclosed in the FIR which casts an
