Provisional anticipatory bail is granted to the petitioner, subject to verification of his antecedent and compliance with the stipulated conditions.

Summary

Petitioner Rahul Kumar, owner of a Toto vehicle, feared arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 59.5 litres of liquor. He argued that he had no conscious possession of the liquor and was unaware that a person named Ranjan misused his vehicle. The petitioner, who has a clean antecedent, sought anticipatory bail. The State opposed the bail. The Court granted provisional anticipatory bail, subject to a bail bond of Rs.500 with two sureties and a six‑week period for surrender, and conditioned the confirmation of bail on verification of the petitioner’s criminal antecedent. If any antecedent is found, the bail will not be confirmed; otherwise it will be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
  • Whether ownership of the vehicle and lack of conscious possession of the seized liquor negate the basis for arrest.
  • Whether the petitioner’s criminal antecedent affects the grant of anticipatory bail.

                   learned A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery of 59.5 liters of liquor from a Toto vehicle.

                                4. Learned counsel for the petitioner submits that

petitioner was not apprehended from the spot as such nothing

was recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of the seized

vehicle. It is next submitted that no prudent person would use

his own vehicle for committing an occurrence and thus would

it is also submitted that petitioner was completely unaware that

Ranjan would misuse the vehicle in the manner as alleged who

was also apprehended from the spot.

                       5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                       6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender before the learned Trial Court

within a period of six weeks from today, be released on

laid down under Section 482 (2) of the BNSS.

                       7. It is made clear that thereafter the learned Trial

Court shall verify the criminal antecedent of the petitioner and

in the event if it is found that petitioner has antecedent of even

one case then it would be presumed that petitioner, for the

purposes of seeking anticipatory bail, had concealed his
