Holding
The Court conditionally granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent.
Summary
Badri Chaudhary, the petitioner, feared arrest in a case alleging possession of 243 litres of liquor recovered from two motorcycles, charging him under IPC sections 272, 273, 414 and 34 and Section 30(a) of the Bihar Excise Act. He contended that he had a clean antecedent, was not in actual possession of the liquor, and was unaware that his friend misused his vehicle. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his antecedent. If any prior case is found, the bail will not be confirmed; if his antecedent is clean, the provisional bail will be confirmed forthwith.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under the applicable provisions.
- Whether ownership of a vehicle used in the alleged offence justifies denial of bail.
- Whether the petitioner’s clean antecedent is a requisite condition for confirming anticipatory bail.

recovery of 243 litres of liquor from two motorcycles.
4. Learned counsel for the petitioner submits that the

7. It is made clear that thereafter the learned Trial Court
shall verify the criminal antecedent of the petitioner and in the
event if it is found that petitioner has antecedent of even one case
then it would be presumed that petitioner, for the purposes of
seeking anticipatory bail, had concealed his antecedent before this
Court, as such, the provisional anticipatory bail order shall not be
confirmed, but after verification if it is found that petitioner is a
