The Court conditionally granted provisional anticipatory bail to the petitioners, subject to bond, sureties, and verification of criminal antecedent.

Summary

The petitioners, six residents of Karamlichak Purbi Bagicha, sought anticipatory bail fearing arrest in a case registered under IPC sections 147, 149, 341, 342, 353, 504, 506 and Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 4,400 litres of liquor from a person named Rahul. They contended that they were not present at the spot of the alleged offence, had no conscious possession of the liquor, and were merely present to free Rahul, asserting clean criminal antecedents. The State opposed the bail, arguing the seriousness of the offences. The Court, after hearing both sides, granted provisional anticipatory bail conditioned on each petitioner furnishing a bail bond of Rs. 500 with two sureties and subject to verification of their criminal antecedents by the trial court. It further directed that if any petitioner is found to have concealed a prior case, the provisional bail would not be confirmed for that individual, but if the antecedent check is clean, the bail would be confirmed.

Issues considered

  • Whether the petitioners are entitled to anticipatory bail under the circumstances described
  • Whether the conditions imposed by the Court, including verification of criminal antecedent, are appropriate
