Naresh KumarversusThe State of Bihar

Decided

DISPOSED

Holding

Provisional anticipatory bail is granted to the petitioner subject to conditions and verification of his antecedent.

Summary

Naresh Kumar, the petitioner, feared arrest in a case under Sections 274, 275 and 317(5) read with Section 30(a) of the Bihar Excise Act for allegedly recovering 162 litres of liquor from three motorcycles. He argued that he had no conscious possession of the liquor, was merely the owner of one of the seized vehicles, and was unaware that another individual, Pappu, misused the vehicle. The State opposed his request for anticipatory bail. The High Court, after considering the petitioner's clean antecedent and lack of direct involvement, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditioned the order on verification of his criminal antecedent by the trial court. If any antecedent is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case under the Bihar Excise Act.
  • Whether the petitioner’s lack of possession and clean antecedent justify granting anticipatory bail.

petitioner was not apprehended from the spot as such nothing
