Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of antecedent cases.

Summary

The petitioner, Saroj Sahni, feared arrest in a case under Section 30(a) of the Bihar Excise Act concerning alleged recovery of 435 litres of liquor and 15,000 litres of fermented jaggery from the Gandak river. He argued that the seized material was not in his possession, the riverbank is a public place, and the complaint originated from a watchman (Chowkidar) with whom he has an inimical relationship, raising doubts about the prosecution's case. The petitioner sought anticipatory bail, while the State opposed it. The Court, considering the submissions, granted provisional anticipatory bail subject to a Rs.10,000 bond, two sureties, and verification of the petitioner’s criminal antecedents within six weeks. The order stipulated that if more than two prior cases are found, the bail would be revoked; if only two, the provisional bail would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act
  • Whether the petitioner’s alleged lack of possession and the public nature of the alleged recovery site justify anticipatory bail
