Bombay High Court
REKHA VIJAYSINH SOLANKEversusTHE STATE OF MAHARASHTRA AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The High Court held that it will not interfere with the Tribunal’s discretionary interim order refusing a stay of the transfer.
Summary
The petitioner, an Assistant Commissioner in the Backward Class Cell, was transferred to the post of Deputy Election Officer in Parbhani, but upon arrival the post was found to be non‑vacant, preventing him from joining. He approached the Maharashtra Administrative Tribunal seeking a stay of the transfer, which the Tribunal refused. The petitioner filed a writ petition under Article 227 of the Constitution challenging the Tribunal’s interim order. The High Court observed that the Tribunal’s decision was discretionary and, at the interim stage, the Court would not interfere with it. However, the Court directed the Tribunal to hear the petitioner’s original application promptly, preferably within six weeks, and disposed of the writ petition without granting any relief.
Issues considered
- Whether the High Court should interfere with the Maharashtra Administrative Tribunal’s discretionary interim order refusing a stay of the petitioner’s transfer
