Since acquisition proceedings under the 2013 Act have been initiated, the petition for direction to acquire the land and pay compensation is deemed moot and is disposed.

Summary

The petitioners alleged that land parcels totaling 2.93 hectares in Daingadewadi village were taken into possession by the Deputy Collector for the construction of a percolation tank without any acquisition proceeding. They sought a court direction to acquire the land and pay compensation with interest from the date of possession. The respondents submitted an affidavit showing that a notification under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 had been issued on 2 February 2026, and that acquisition proceedings had been initiated following representations by the farmers. The court observed that the acquisition process was already underway, rendering the petition’s relief unnecessary. Issues concerning the quantum of compensation and entitlement to interest were left open, and the writ petition was disposed.

Issues considered

  • Whether the taking of possession of land for a percolation tank without prior acquisition violates the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013.
  • Whether the court can direct acquisition and payment of compensation with interest in the absence of a formal acquisition proceeding.
  • Whether the issuance of a notification under Section 11(1) of the 2013 Act suffices to bar the petition.
