Since a Section 11(1) notification under the 2013 Land Acquisition Act had been issued, the acquisition process was deemed to have commenced, and the writ petition was dismissed.
Summary
The petitioners alleged that several land parcels in Mouza Shetphal, Solapur were taken into possession by the Deputy Collector for the construction of Percolation Tank No.11 without any formal acquisition. They sought a directive for the authorities to acquire the land and pay compensation with interest from the date of possession. The respondents submitted an affidavit showing that a notification under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 had been issued on 2 February 2026, following representations by the farmers and subsequent letters from the Planning Department and the Deputy Collector (Coordination Branch). The court observed that acquisition proceedings had already been initiated, rendering the relief sought in the petition moot. Consequently, the court disposed of the writ petition, leaving the quantum of compensation and interest issues open for determination in the pending acquisition process.
Issues considered
- Whether possession of land for a percolation tank without prior acquisition violates the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013
- Whether the petitioners are entitled to compensation with interest from the date of possession
- Whether the filing of a Section 11(1) notification suffices to bar the writ petition
