The High Court, exercising its supervisory jurisdiction under Article 227, directed the Family Court, Jhansi to decide the pending case within six months.
Summary
The petitioners, Smt Juhi Khan and another, filed a petition under Article 227 of the Constitution seeking a direction to the Principal Judge of the Family Court, Jhansi, to expedite the pending case No. 481 of 2025 (Smt Juhi Khan & others v. Jawed Khan) that was proceeding under Section 144 of the B.N.S.S. Police Station, Mahila Thana, Jhansi. The petitioners argued that the family court proceedings were unduly delayed and requested a time‑bound disposal. The High Court, after hearing counsel for the petitioners and the State’s A.G.A., exercised its supervisory jurisdiction and ordered the family court to decide the matter within six months of the certified copy of the order. The direction was intended to ensure a speedy resolution of the family dispute. The order was signed by Justice Vikram D. Chauhan and the petition was disposed with the said direction.
Issues considered
- Whether the High Court can, under its supervisory jurisdiction under Article 227, direct a Family Court to decide a pending case within a specified time frame
