The petition was dismissed and the High Court did not issue any direction, directing the petitioner to approach the trial court for expeditious disposal.
Summary
Richcredit Finance Private Limited filed a petition under Article 227 of the Constitution seeking a direction to the Special Court (N.I. Act), Ghaziabad, to dispose of a pending complaint under Section 138 of the Negotiable Instruments Act filed on 17‑08‑2023. The petitioner argued that the trial court was merely fixing dates and that the prolonged pendency was causing serious prejudice, urging the High Court to set a specific timeline for disposal. The Court noted the urgency but directed the petitioner to file an application before the trial court seeking expedited treatment, leaving the matter to the lower court’s discretion. No substantive interference with the trial court’s jurisdiction was made. Consequently, the petition was dismissed without any order directing the trial court. The matter was thereafter listed as disposed.
