Allahabad High Court

ASHA DEVI AND 2 OTHERSversusRAJENDRA PRASAD SINGH

Decided

Holding

The High Court exercised its supervisory jurisdiction under Article 227 to direct the Civil Judge to decide the pending suit expeditiously and disposed of the writ petition.

Summary

The petitioners filed a writ petition under Article 227 seeking a direction to the Civil Judge (J.D.) Muhammadabad, Gohana, Mau, to decide Original Suit No. 50 of 2021 (Rajendra Prasad Singh v. Mevati & others) as expeditiously as possible. The petition sought only this supervisory direction and no other relief. The High Court noted that the original suit was still pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition, directing the lower court to decide the suit promptly according to the roster, and ordered that no notice be issued to the respondents. The order effectively closes the writ petition while mandating faster disposal of the underlying suit.
