Allahabad High Court

SMT. RAVINA KHATOONversusMANOJ KUMAR AND 2 OTHERS

Decided

Holding

The writ petition is dismissed and the Civil Judge (S.D.) Gorakhpur is directed to expedite the pending suit O.S.No.218 of 2022 without unnecessary adjournments.

Summary

The petitioner, Smt. Ravina Khatoon, filed a writ petition under Article 227 of the Constitution seeking a direction to the Civil Judge (S.D.) Gorakhpur to expedite the pending suit O.S.No.218 of 2022 (Ravina Khatoon v. Manoj Kumar & others). The sole relief claimed was that the lower court decide the suit within a specific period fixed by the High Court. The Court observed that keeping the writ petition pending served no useful purpose while the suit itself was still pending. Consequently, the Court disposed of the writ petition and directed the Civil Judge to expedite the suit without unnecessary adjournments, subject to any legal impediment. The order was pronounced on 18 May 2026 by Justice Vikas Budhwar.
