Allahabad High Court

NARENDRA NATH GUPTAversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application under Section 482 Cr.P.C. to quash the non‑bailable warrant is dismissed as the applicant failed to comply with the mediation order.

Summary

The applicant, Narendra Nath Gupta, filed a Section 482 Cr.P.C. application seeking to quash a non-bailable warrant dated 18‑03‑2023 issued in a complaint under Section 138 of the Negotiable Instruments Act. The warrant arose from Complaint Case No.19737 of 2021 (Vipin Agarwal v. Narendra Nath Gupta & Another) pending before the Additional Court, Mathura. The court had earlier referred the matter to a Mediation Centre and ordered the applicant to deposit Rs.1,05,000, which the applicant failed to do despite extensions. The mediation report dated 01‑04‑2026 confirmed non‑payment, and the court observed that the applicant’s conduct was mischievous. Consequently, the High Court dismissed the Section 482 application, refusing to quash the warrant.

Issues considered

  • Whether a Section 482 Cr.P.C. application can be entertained to quash a non‑bailable warrant when the applicant has failed to comply with a mediation‑ordered deposit.
  • Whether the applicant’s non‑payment of the mediation amount constitutes misconduct justifying dismissal of the quash petition.
