Allahabad High Court

RIZWAN AND 6 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court held that the proceedings are quashed as the parties have settled their grievances, consistent with Supreme Court precedent.

Summary

The applicants filed a petition under Section 482 of the CrPC seeking to quash the cognizance order and charge‑sheet in a criminal case (Criminal Case No.2477/2024) involving offences under Sections 498‑A, 323, 504 IPC and Sections 3 and 4 of the Dowry Prohibition Act. The matter was referred to the High Court Mediation and Conciliation Centre, where the parties reached a compromise and deposited a settlement sum. Both the applicants and the opposite party consented to the settlement and the opposite party raised no objection to quashing the proceedings. Relying on a line of Supreme Court decisions that allow quashing of criminal matters where the parties have settled their grievances, the Court exercised its inherent powers under Section 482 CrPC. The Court ordered the complete quash of the proceedings against the applicants and allowed the application.

Issues considered

  • Whether a criminal proceeding can be quashed under Section 482 CrPC on the basis of a settlement reached between the parties.
  • Whether the settlement extinguishes liability under the specific IPC and Dowry Prohibition Act provisions alleged.
  • Whether the High Court has jurisdiction to quash the cognizance order and charge‑sheet in the present case.
