Allahabad High Court

MOHD WARIS AND 9 OTHERSversusState of U.P. AND ANOTHER

Decided

Holding

The Court quashed the charge sheet and the entire prosecution, holding that no useful purpose would be served by continuing the case after a valid compromise.

Summary

The husband, Mohd Waris, and nine others were charged under Sections 498A, 323, 504, 506, 354, 354-A of the IPC and Sections 3 and 4 of the Dowry Prohibition Act following a matrimonial dispute. The wife filed an FIR, but the parties later reached a compromise through a mediation centre, agreeing to live together peacefully and withdraw all pending claims. Both the wife and the State’s counsel expressed no objection to quashing the proceedings. Relying on Supreme Court precedents that allow compromise even for certain cognizable and non‑compoundable offences, the High Court held that continuing the prosecution would serve no useful purpose. Consequently, the charge sheet, summons and the entire prosecution were quashed under Section 482 of the Cr.P.C.

Issues considered

  • Whether a prosecution for offences including 498A, 323, 504, 506, 354, 354-A IPC and 3/4 Dowry Prohibition Act can be quashed under Section 482 Cr.P.C. after the parties have reached a compromise.
  • Whether compromise is permissible for the said cognizable and non‑compoundable offences.
