Allahabad High Court
ANOOP CHANDRA MISHRAversusSTATE OF U.P.
- Decided
- Bench
- VIKRAM D CHAUHAN
Holding
Bail was granted to the accused under Section 7 of the Prevention of Corruption Act.
Summary
The applicant, a Revenue Inspector, was arrested for allegedly demanding Rs.10,000 in a land‑mutation case and was caught with the money. He has no prior criminal record and has been in custody since 19‑Feb‑2026. The State opposed bail but did not allege any risk of evidence tampering, witness intimidation, or flight. The Court noted the constitutional presumption in favour of bail under Article 21 and the lack of any exceptional circumstances. Applying the principles reiterated in Satyendra Kumar Antil v. CBI, the Court held that the applicant had made out a case for bail and ordered his release on personal bond and sureties with standard conditions.
