Allahabad High Court
NADEEM KURAISHI @ BABLIversusSTATE OF U.P.
- Decided
Holding
The Court held that bail should be granted.
Summary
The Allahabad High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Nadeem Kuraishi, who was arrested in connection with a case under Sections 3, 5 and 8 of the Cow Slaughter Act. The applicant asserted that he was falsely implicated, that the FIR was originally lodged against unknown persons, and acknowledged a criminal history of sixteen cases while undertaking not to misuse liberty. The State opposed bail, emphasizing the seriousness of the offence and the applicant’s prior record. After reviewing the record, the Court, without expressing an opinion on the merits, found the matter fit for bail and ordered his release on a personal bond of Rs. 50,000 with two sureties and specific conditions. The order clarified that it does not prejudice the trial court’s independent assessment of the case.

- Whether bail should be granted to the accused under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a case under the Cow Slaughter Act despite his prior criminal history
