Allahabad High Court

SUFIYANversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that prima facie the applicant has made out a case for bail and therefore granted bail.

Summary

The High Court considered a bail application filed by Sufiyan, who was arrested in connection with a case under Sections 137(2), 64(1), 87 of the Indian Evidence Act and Sections 5(l) and 6 of the POCSO Act. The applicant claimed innocence, stating that the alleged victim is a consenting adult who had expressed willingness to stay with him and that they have a child together. The State opposed bail, but the court noted the victim's consent, the applicant's clean record, and his willingness to cooperate. Without passing on the merits, the court found a prima facie case for bail. Accordingly, bail was granted on personal bond and two sureties with standard conditions.

Issues considered

  • Whether bail should be granted to the accused under the Indian Evidence Act and POCSO Act given the victim's consent and the nature of the alleged offence.
  • Whether the applicant's lack of criminal history and cooperation are sufficient grounds for bail.
