Allahabad High Court

MANISH YADAVversusSTATE OF U.P.

Decided

Holding

The court granted bail to Manish Yadav.

Summary

Manish Yadav was charged under Sections 3, 5A, 5B and 8 of the Cow Slaughter Act and Section 11 of the Prevention of Cruelty to Animals Act in Crime No.126 of 2025. He applied for bail while the trial was pending. The court examined the facts, the submissions of counsel, and noted that a co‑accused, Harsh Singh, had earlier been granted bail in a similar case. Since the applicant had no prior criminal record and the principle of parity applied, the court found sufficient grounds to grant bail. Bail was ordered on the condition of a personal bond, two sureties, and compliance with standard conditions such as not tampering with evidence or intimidating witnesses.

Issues considered

  • Whether bail should be granted to the accused under the Cow Slaughter Act and the Prevention of Cruelty to Animals Act charges.
  • Whether the principle of parity with a co‑accused who was previously released on bail justifies granting bail in the present case.
