Allahabad High Court

KAMLESH BHARTIYAversusSTATE OF U.P.

Decided

Holding

The bail application is allowed and the applicant is released on bail subject to the stipulated conditions.

Summary

The High Court considered a bail application filed by Kamlesh Bhartiya, who was arrested in Crime No. 412 of 2026 under Sections 109(1) and 115(2) of the B.N.S. The applicant claimed false implication and pointed out that a similarly situated co‑accused, Neeraj Bhartiya, had already been granted bail by a coordinate bench of the same court. The State opposed bail but could not dispute the earlier bail order. After reviewing the facts, the court noted the applicant’s lack of criminal antecedents and his prolonged pre‑trial detention since 20‑08‑2026, and held that the earlier bail order had not been stayed by the Supreme Court. Consequently, the court allowed the bail application, directing the applicant to furnish a personal bond, two sureties and to comply with several conditions regarding court attendance and non‑adjournment. The order also warned that breach of any condition would be grounds for cancellation of bail.

Issues considered

  • Whether Kamlesh Bhartiya is entitled to bail under Sections 109(1) and 115(2) of the B.N.S. in view of a similarly situated co‑accused having been granted bail.
  • Whether the applicant’s lack of criminal antecedent and prolonged pre‑trial detention justify the grant of bail.
  • Whether the conditions imposed on bail are lawful and sufficient to ensure the applicant’s presence at trial.
