Allahabad High Court

MANISH BINDversusSTATE OF U.P.

Decided

Holding

Bail was granted to the accused without touching the merits of the case.

Summary

Manish Bind applied for bail in a criminal case (Crime No. 71 of 2026) under Sections 3, 5A and 8 of the Cow Slaughter Act and Section 11 of the Prevention of Cruelty to Animals Act. He was arrested on 28 August 2026 for allegedly transporting three cattle for slaughter, with the recovery made in the absence of an independent witness. The applicant has no prior criminal record and has been in custody since the arrest. The State opposed bail but did not dispute the facts. The Court, noting the lack of an independent witness and relying on Supreme Court dicta in Girish Gandhi v. State of U.P. (2024 10 SCC 674) and Policy Strategy for grant of bail in re (2024 10 SCC 685), allowed the bail application without addressing the merits, directing release on personal bond and sureties. The accused was ordered to cooperate with the judicial process for a speedy disposal of the case.

Issues considered

  • Whether bail should be granted when the arrest and recovery were made without an independent witness.
  • Whether the seriousness of offences under the Cow Slaughter Act and the Prevention of Cruelty to Animals Act precludes bail.
