Allahabad High Court

SHIVAMversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

Bail was granted to the applicant on the ground of parity with the co‑accused.

Summary

Shivam, accused in Crime No.516 of 2026 for offences under the Indian Penal Code, the B.N.S. Act and Sections 5/6 of the POCSO Act, sought bail during the pendency of trial. He argued that a co‑accused, Ravi, with an identical role and no prior criminal record, had been granted bail, establishing parity. The State opposed the bail, but did not dispute the parity claim. Citing the precedent of Nanha S/o Nabhan Kha v. State of U.P. (1993) and Supreme Court decisions in Paras Ram Vishnoi v. Director, CBI (2021) and Satender Kumar Antil v. CBI (2022), the Court held that the applicant had made out a case for bail. Accordingly, bail was granted on the condition of a personal bond, two sureties, and compliance with standard bail conditions.

Issues considered

  • Whether bail should be granted to the accused during trial for the alleged offences.
  • Whether the grant of bail to a co‑accused on identical charges creates a binding parity principle for the applicant.
  • Whether the applicant poses a risk of tampering with evidence or fleeing.
