Allahabad High Court
HARENDRAversusSTATE OF U.P.
- Decided
Holding
The court held that the applicant is entitled to bail as the case is fit for bail and no specific role has been attributed to him in the FIR.
Summary
The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Harendra, who was arrested in connection with a case involving multiple offences including assault and grievous injury to an 84‑year‑old informant. The applicant claimed innocence and pointed out that several co‑accused had already been granted bail, arguing that his role was indistinguishable from theirs. The State opposed bail, emphasizing the serious nature of the alleged assault and the injury to the senior victim. The court, after reviewing the FIR and noting that no specific role was assigned to the applicant, concluded that the case was suitable for bail without expressing any view on the merits. Consequently, the bail was granted subject to a personal bond of Rs. 50,000 and several conditions to prevent witness tampering and ensure the applicant’s presence at trial dates.
Issues considered
- Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 despite the seriousness of the charges.
- Whether the applicant’s alleged involvement and the injury to an elderly victim justify denial of bail.
- Whether there is a risk of the applicant tampering with evidence or intimidating witnesses.
