Allahabad High Court

BHUPENDRA PATELversusSTATE OF U.P.

Decided

Holding

The Court held that bail is appropriate and granted it to the applicant under the conditions specified.

Summary

The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for Bhupendra Patel who was charged under Sections 8, 20 and 29 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for alleged possession of 28.135 kg of ganja recovered from a vehicle. The applicant claimed innocence, alleging false implication and that no narcotics were found in his conscious possession, and argued that mandatory provisions of Sections 50, 52‑A of the NDPS Act and Section 105 of the BNSS were not complied with. The State opposed bail, emphasizing the commercial quantity involved. Relying on Section 37 of the NDPS Act and the precedent set in Union of India v. Shiv Shanker Kesari, the Court found the case suitable for bail without commenting on the merits. Consequently, the Court granted bail on a personal bond of Rs. 50,000 with two sureties and imposed standard conditions, warning that breach would lead to cancellation.

Issues considered

  • Whether bail can be granted under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a case involving alleged possession of a commercial quantity of narcotics.
  • Whether the mandatory provisions of Sections 50 and 52‑A of the NDPS Act and Section 105 of the BNSS were complied with, affecting bail eligibility.
  • Whether the alleged facts and the nature of the offence justify denial of bail despite the commercial quantity of ganja.
