Allahabad High Court

PRABHANAND AND ANOTHERversusRANI GARIMA JAISWAL, SUB DIVISIONAL OFFICER

Decided

Holding

The contempt application is dismissed as infructuous because the opposite party complied with the writ court’s order.

Summary

The High Court noted that in Writ‑C No. 18326/2023 it had directed the opposite party to decide proceedings under Section 24 of the Uttar Pradesh Revenue Code, 2006. The opposite party filed a compliance affidavit on 1 October 2024 stating that the required proceedings were concluded on 27 September 2024 and attached the order as annexure. The court examined whether the contempt application filed by the petitioners remained viable after such compliance. Finding that the order of the writ court had been fully complied with, the court held that the contempt application was rendered infructuous. Consequently, the contempt notice was discharged and the application dismissed.
